Mytapu.com will have access to third party personal information provided by you as part of using Mytapu.com Services such. This information may include third party names, email addresses, phone numbers and physical addresses and will be used for servicing your requirements as expressed by you to Mytapu.com and solely as part and parcel of your use of Mytapu.com Services. When you elect to refer friends to the website, we request their email address and name to facilitate the request and deliver email. Your friend may contact us at email@example.com to request that we remove this information from our database.
We post user testimonials on our website. These testimonials may include names and other Personal Information and we acquire permission from our users prior to posting these on our website. Mytapu.com is not responsible for the Personal Information users elect to post within their testimonials.
This is an agreement, between you or the entity that you represent (hereinafter “You” or “Your”) and Mytapu.com (hereinafter ‘We’, ‘Us’) governing your use of Mytapu.com online platform and real estate Services.
We accept orders and instructions subject to our terms and conditions and only on the basis that those instructing us do so as principals and are liable directly to us for payment of our account.
If you instruct us in relation to work we may, as your agent, directly or through an intermediary request another contractor to carry out some or all of this work for you. In such circumstances we have no control over the activities of those providing the Services to you (”Third Party Contractors”). We take all reasonable care to choose Third Party Contractors with good reputations and in instructing them on your behalf. We accept no responsibility however for the Services Third Party Contractors provide neither to you nor for any errors or omissions in their work product. If a mistake is made by Third Party Contractors that causes you loss, we will, on being properly secured by you as to costs, co-operate with you in bringing proceedings against the contractor concerned. Acting as agent we shall pay the charges of Third Party Contractors on your behalf and recharge them to you with our own agency fees.
Adequacy of Instructions
We provide Services only on the basis that those instructing us give us all proper, necessary and timely instructions, authority and information (including the execution of all documents required) to enable us to undertake lawfully and effectively the business instructed, and indemnify us accordingly. We are not liable for any errors or omissions in the information provided to us or for the consequences of such errors and omissions. Failure to provide adequate instructions or contactable telephone numbers will delay the processing of an instruction or service. We are not liable for such failure by customers and will not be liable for cost or loss incurred whether direct or consequential.
It is our policy to observe confidentiality with regard to the identity and affairs of our customers to the extent permitted by law, but, in common with other service providers, we may be required exceptionally to disclose information to governmental and other public authorities.
Personal Information and Privacy
Not Legal, Accountancy, or Tax Advice
We endeavour to provide true and correct information on all Services, not providing legal or accountancy or tax advice. Information contained in this site is for guidance purposes only. Before proceeding it may be advisable that independent advice is sought from appropriately qualified persons familiar with each individual’s personal circumstances. Further, at no time may we be held liable for advice provided by any and or all our partners, associates, officers, or service providers.
Right to Refuse
We specifically reserve the right to refuse any and/or all Services to any client without giving any reason or explanation.
The charges for our Services shall be as specified to you. Payment is taken at the time of selection and purchase of Services level and type, as standard policy, with payment receipt confirmed prior to inception of Services provision. We reserve the right to charge for costs and expenses incurred in recovering late payments and overdue amounts. Fees are non-refundable, except as provided for within these Terms.
Performance of Contract
You agree to: a) provide true, accurate, current and complete information about yourself as required during the business process; and b) maintain and promptly update the information provided to keep it true, accurate, current, and complete. If you provide any information that is untrue, inaccurate, outdated, or incomplete, or if Mytapu.com has reasonable grounds to suspect that such information is untrue, inaccurate, outdated, or incomplete, Mytapu.com may terminate and/or refuse current or future use of any or all of the Services.
You, as the instructing party, accept and agree to comply with, and be bound by all undertakings, commitments, obligations, requests, and terms of power of attorney, and terms and conditions of business, granted to agents, advocates, and third party facilitators, real estate transaction management platforms and real estate e-commerce platforms, engaged on your behalf, for the purposes of executing the Services and activities you have directed and instructed.
You, as the instructing party, accept and agree to comply with all requests for documentation required in the course of satisfying regulatory requirements including anti-money laundering.
You grant Mytapu.com permission to access, copy, distribute, store, transmit, reformat, publicly display and publicly perform the content of you have provided solely as required for the purpose of providing the Services to you.
In event of the performance of any obligation accepted by the company being prevented, delayed or in any way interfered with by either a) An act of god, outbreak of war, either general or local riot or other civil commotion, strike, lockout, act or decree of any government or any other act, matter or thing beyond our reasonable control,
b) Non-delivery or non-performance by the company’s suppliers or damage, loss or destruction of the whole or part of the goods or work, c) By any cause beyond the company’s control, the company may at its option suspend performance or cancel its obligation under the contract without liability for any damage or consequential loss resulting there from such suspension or cancellation being without prejudice to the company’s right to recover all sums owing to it in respect of consignments delivered, or collected and costs incurred to date.
Communications from Mytapu.com
The Services may include certain communications from Mytapu.com, such as Services announcements, administrative messages and newsletters. You understand that these communications shall be considered part of using the Services. As part of our policy to provide you total privacy, we also provide you the option of opting out from receiving newsletters from us. However, you will not be able to opt-out from receiving Services announcements and administrative messages.
If we receive a complaint from any person against you with respect to your activities as part of use of the Services, we will forward the complaint to the primary email address of your user account. You must respond to the complainant directly within 10 days of receiving the complaint forwarded by us and copy Mytapu.com at OPS@mytapu.com in the communication. If you do not respond to the complainant within 10 days from the date of our email to you, we may disclose your name and contact information to the complainant for enabling the complainant to take legal action against you. You understand that your failure to respond to the forwarded complaint within the 10 days’ time limit will be construed as your consent to disclosure of your name and contact information by Mytapu.com to the complainant.
Restrictions on Use
In addition to all other terms and conditions of this Agreement, you shall not: (i) transfer the Services or otherwise make it available to any third party; (ii) provide any Services based on the Services without prior written permission; (iii) use the third party links to sites without agreeing to their website terms & conditions; (iv) post links to third party sites or use their logo, company name, etc. without their prior written permission; (v) publish any personal or confidential information belonging to any person or entity without obtaining consent from such person or entity; (vi) use the Services in any manner that could damage, disable, overburden, impair or harm any server, network, computer system, resource of Mytapu.com; (vii) violate any applicable local, state, national or international law; and (viii) create a false identity to mislead any person as to the identity or origin of any communication.
Spamming and Illegal Activities
You agree to be solely responsible for the contents of your transmissions through the Services. You agree not to use the Services for illegal purposes or for the transmission of material that is unlawful, defamatory, harassing, libelous, invasive of another's privacy, abusive, threatening, harmful, vulgar, pornographic, obscene, or is otherwise objectionable, offends religious sentiments, promotes racism, contains viruses or malicious code, or that which infringes or may infringe intellectual property or other rights of another. You agree not to use the Services for the transmission of "junk mail", "spam", "chain letters", “phishing” or unsolicited mass distribution of email. We reserve the right to terminate your access to the Services if there are reasonable grounds to believe that you have used the Services for any illegal or unauthorized activity.
Mytapu.com, the names of individual Services and their logos are trademarks you agree not to display or use, in any manner, without prior written permission.
Disclaimer of Warranties
YOU EXPRESSLY UNDERSTAND AND AGREE THAT THE USE OF THE SERVICES IS AT YOUR SOLE RISK. THE SERVICES ARE PROVIDED ON AN AS-IS-AND-AS-AVAILABLE BASIS. MYTAPU.COM EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. MYTAPU.COM MAKES NO WARRANTY THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE. USE OF ANY MATERIAL DOWNLOADED OR OBTAINED THROUGH THE USE OF THE SERVICES SHALL BE AT YOUR OWN DISCRETION AND RISK AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM, MOBILE TELEPHONE, WIRELESS DEVICE OR DATA THAT RESULTS FROM THE USE OF THE SERVICES OR THE DOWNLOAD OF ANY SUCH MATERIAL. NO ADVICE OR INFORMATION, WHETHER WRITTEN OR ORAL, OBTAINED BY YOU FROM MYTAPU.COM, ITS EMPLOYEES OR REPRESENTATIVES SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE TERMS.
Except in respect of claims for death or personal injury resulting from negligence or as otherwise prohibited by law, we have no liability for loss or damage (direct, indirect or consequential) arising out of any single claim, event, or series of related claims or events (including claims based on negligence).
These terms of business are not exhaustive and there are other terms and/or conditions which relate to other Services. Please read them. By purchasing a Service you are also acknowledging the other General Terms of Trade as well as any which may be specific to that product or Services. By accepting these terms you affirm that you have read and agreed to others posted on the legal section of our website.
YOU AGREE THAT MYTAPU.COM SHALL, IN NO EVENT, BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, INDIRECT, SPECIAL, PUNITIVE, OR OTHER LOSS OR DAMAGE WHATSOEVER OR FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, COMPUTER FAILURE, LOSS OF BUSINESS INFORMATION, OR OTHER LOSS ARISING OUT OF OR CAUSED BY YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF MYTAPU.COM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. IN NO EVENT SHALL MYTAPUS.COM ENTIRE LIABILITY TO YOU IN RESPECT OF ANY SERVICES, WHETHER DIRECT OR INDIRECT, EXCEED THE FEES PAID BY YOU TOWARDS SUCH SERVICES.
You agree to indemnify and hold harmless Mytapu.com, its partners, associates, officers, directors, employees, suppliers, and affiliates, from and against any losses, damages, fines and expenses (including attorney's fees and costs) arising out of or relating to any claims that you have used the Services in violation of another party's rights, in violation of any law, in violations of any provisions of the Terms, or any other claim related to your use of the Services, except where such use is authorized by Mytapu.com.
Right to Amend Terms & Conditions
We expressly reserve the right to modify these terms and conditions at any time by making such modifications on this page of the website to take into account changing circumstances. If Services are ordered in the future, the Instructing/Paying Party is advised to revisit the Terms & Conditions pages of the website to familiarize themselves with any amendments that may have been made.
Suspension and Termination
We may suspend your user account or temporarily disable access in whole or part of any Services in the event of any suspected illegal activity, extended periods of inactivity or requests by law enforcement or other government agencies. Objections to suspension or disabling of user accounts should be made to OPS@mytapu.com within thirty days of being notified about the suspension. In addition, we reserve the right to terminate and deny the Services upon reasonable belief that you have violated the Terms. You have the right to terminate the Services if Mytapu.com breaches its obligations under these Terms and in such event, you will be entitled to prorated refund of any prepaid fees. Termination of user account will include denial of access to all Services, deletion of information in your user account such as your email address and deletion of all data in your user account.
