These same agents do not even appear in a search engine listing in Turkish. The reason is simple- these type of agents serving foreign investors pay money for various techniques to obtain results for top search engine listings and rankings in foreign languages to catch unsuspecting foreign buyers.

 Dis-Honest Practices:

These agents can afford to pay this money because the procedures and practices the agents apply when dealing with foreign buyers and sellers, ensure they profit far more than merely from collecting a 2-3 % commission. This is their ‘standard business practice’, involving a series of steps that are intentionally designed to limit a foreign buyer’s negotiating power, and visibility. Usually these steps are combined with different pressure tactics involving fictitiously created urgency, and other emotional and psychological tactics, accompanied by persuasive skills, and often various degrees of dramatic amateur ‘acting’. 

Profits from Hidden Price Mark-Ups:

These practices typically involve the ‘hidden price mark-up’ scam – where-by an agent agrees not to charge a seller (or developer/constructor) a commission, if the agent can keep all money obtained by selling the property for more than a specific price level. And the profit from selling above that price- the hidden price mark up -  agents put in their pocket as their profit- often shared with the attorneys they recommend to clients, the Citizenship CBI/CIP consultants they work with, valuation experts, and mortgage brokers that provide false assurances of mortgage finance, just to encourage the client’s to make deposit payments in advance. 

Don’t Believe It… !

Just because an agent’s website is now providing information on ‘Due Diligence’, does NOT mean they actually perform professional Due Diligence. Usually, the agent has simply obtained the information on this and other topics from MyTapu’s website and placed onto their own website to appear legitimate… a common practice for years !

Just One Business- Manipulation:

Avoiding these practices can NOT be done by using an agent that relies on these practices for their business, because no matter what persuasive assurances they provide, these practices ARE their business- not providing standard real estate agency services. So for example, if a buyer wants to offer a price without deposit or below listing price to a seller, the agent’s usual ploy will be to not to inform the seller at all, and eventually inform the buyer falsely.’ there is another buyer at a higher price’ , or ‘the property has been sold’, or ‘the property has been taken off the market’… and neither the seller nor the buyer will know any different – because they both rely on the agent’s communication. This is a major reason why local Turk’s do not use agents. In summary, the only business these agents are interested in doing, is the business of capturing the hidden price mark-up profit- they won’t bother doing anything else. Which becomes understandable when realizing that the ‘hidden price mark-up profits’ can amount to as much as 80% higher than the true sales price.

Yes, FOR a factual real world EXAMPLE, a USD $ 100,000 price mark-up on a  $ 186,000 property being offered for sale at $ 286,000 in Kagithane, istanbul.

  • Price Checks: Use a Professional Valuation Service instead of a local appraisal report known as an Eksper Rapor, because the Eksper Report does not provide accurate market price valuations because they charge so little it is not possible to obtain accurate information on real transaction prices of comparable properties, and instead relies on price averaging and other short-cuts resulting in distortions. An Eksper Rapor provides much helpful information but the attention to market price discovery typically comprises less than 10-15% of such reports. 
  • Preparations: Complete the advance preparations necessary to ensure the buyer is able to buy property like a local Turkish person;
  • Timing: allow ample time for a price negotiation to be accepted –less than ninety days is often not sufficient, so expectations must be managed realistically in regard to seasonal factors and other aspects;
  • Choices: Maintain a wide range of property purchase choices, without becoming emotionally attached to any pictures or concepts – this is a small price to pay for protecting wealth. 
  • Persistence: patiently continue with the techniques applied by an experienced Professional Transaction Specialist, and do not be deterred by agents’ refusals to cooperate, because non-cooperation is obviously a red-flag that is best avoided.  Also avoid entering a situation where an agent provides a constant stream of false and misleading information, and uses psychological and emotional persuasion tactics.
  • Sourcing: avoid any service providers that are being paid commissions – instead, use a non-commission based services for identifying property to buy, like MyTapu’s Property Search and Selection Service.     So search engine algos receive huge input volumes of false information,  but how does that false information come into existence on the internet in the first place?

     

    The primary reasons are:


    Agents’ Practices – Agents priorities are to maximize and secure their commission and ‘hidden price-markup profits’ as early as possible in the sales process. For that purpose, agents are true experts – every other consideration is secondary, or non-existent. Providing mis-information that misleads a buyer for this purpose is very profitable, The information is free, but the results that mislead the buyer provide the agents with huge profits that often range as high as 50% of the true market value of the property- and that 50% is the buyer’s ‘hidden cost’- which is very real, as the buyer discovers when they try to sell the property- which is usually years later. Free information is very costly, and in reality is very expensive .

     

    Social Media, Blog References & Discussion Boards - Recent research reveals that 80% of internet buyers research blog articles and discussion boards before completing a purchase. Unfortunately a very large proportion of the information on blogs and discussion boards is also inaccurate and misleading. Often this is because agents are writing the information while using membership identities to appear as buyers. Many times the incorrect and inaccurate information is provided by a bonafide, authentic buyer, and describes what they know- but what they know is usually some small fraction of the facts they learned from brief discussions with informed sources, but most often is obtained from hearsay because they themselves never paid fees to receive independent professional advice, because they chose instead to save money and use ‘free’ advice, which has resulted in huge hidden costs, which they may not yet be aware of ! Blogs and discussion boards are not a reliable source of information.

     

    Information Created by Artificial Intelligence (AI)– the huge increase in the use of AI to create information on the internet (websites, articles, research data, etc) has replicated the proliferation of false and misleading information on the internet. The AI algos (see above) produce the new information by scanning the internet and compiling the same false and misleading information into new false and misleading information (garbage in leads to garbage out).  The volume of false and misleading information is now larger than ever, and search engines rank that information very highly, not because it is correct and accurate, but because the AI algos are very good at structuring the presentation of the inaccurate and incorrect information.

     

    The irony is that many ‘trusted and reputable’ sources of information are ranked highly in search results because they are considered an ‘authority’ – even when the information provided is incorrect and inaccurate... but only an expert can know this.

     

    Very good examples of this are ‘Trust Pilot’ and ‘Scam Advisor’. These websites thrive on a valuable concept of exposing fraudsters by naming and shaming publicly… Unfortunately, they also enable fraudsters and scammers to cover their dastardly deeds with ‘reputation management’ that involve the scamsters posting a large number of fake customer reviews that make them look great.     There are Two Primary Reasons why false and inaccurate information dominates search engines rankings for English Search Results about Property in Turkey ….


    The first reason, is because the English-speaking agents with English language websites, produce large quantities of free information that is incorrect and inaccurate to mislead customers for the purpose of the agent maximizing their profits. The extent of this problem for Turkish language information is far less.

     

    The second reason  is because false and misleading information is provided for free, because it is worse than worthless; instead it leads to huge profits for the authors that provide it… (usually agents, but also other Citizenship advisors, lawyers, appraisal experts- anyone and everyone that has a conflict of interest because they share the huge hidden profits with the agent- profits the property buyer pays for). Factually correct and accurate information has value, and is not provided for free… see below.

     Factually correct and accurate information has value, and is not provided for free, because the professional advisors know the value, and charge fees for their expertise.  The value of the information saves the buyer and investor  tens-of-thousand in hidden costs the buyers otherwise pay to agents benefiting from  hidden profits.

     

    The Search Algos have great difficulty in evaluating the best sources of factually correct and accurate information, because the information does not appear for free on the internet.

     

    So unless you hear of a good source by word of mouth verbally, it is very difficult to identify factually from internet search results.  Private networks of like minded groups of people sharing their first hand experiences privately, are a solution that helps, but the information is not on the internet, but sometimes may be in encrypted chat networks on apps like Telegram Messenger. One means of identifying this authority, is not by links (which Search algo do use to a limited extent), but by direct access to a businesses website domain name url. For example, the simple and easy-to-type domain name mytapu.com, is the source of 80%+ of all reader traffic on the MyTapu website… and that reader traffic is very large. Most viewers and readers do not arrive on the mytapu website from search engine results- instead they arrive from a more trusted source- word of mouth referrals from their off-line communities.. This is the true essence of the ‘:MyTapu’ brand value. The validity of this authority is becoming fully comprehended by Search Algos, as is the case with other businesses with strong brand reputation. .

     

    In contrast, the practice of incorporating generic terms into a domain name, like incorporating two search term keywords, for example,  ‘Property’ and ‘Turkey’ into ‘PropertyTurkey’ is clearly a tactic for the sole purpose of capturing new and unsuspecting internet search traffic… instead of knowledgeable and informed buyers and investors.  and may be interpreted as being intentionally gaming search engine algos, instead of a source of authority.

    When the world’s largest, smartest, and best performing investors (like institutional fund managers) want valuable investment advice, that is not factually incorrect nor misleading, where do they find it? Do they go to an estate agent ? Do they expect to receive it from people with no qualifications  in the subject ? With no higher educational degrees in the subject ? With no experience working in highly reputable, professional institutional organizations ? Advisers with no professional licenses ?

     

    No, professional investors do not rely on advice from people without specific degrees, reputable experience, nor professional licenses. If they did, their investment performance would not maintain their reputations for long. Instead they seek this caliber advice from investment banks, and professional consulting & advisory firms. This is called independent professional advice.  Or to be certain the advice is independent and therefore best advise for the purpose, they may choose to hire the experts to work in their firm.

     

    The choice from all of these solutions ensures their success, and...


    All the choices for independent professional advice, have three common qualifying characteristics:

     

    Independent- the advisor has no conflict of interests with the investor, but instead has the same mutually aligned interests. Not like agents and the lawyers and Citizenship advisors that collude together to defraud the investor by sharing hidden profits at the buyers’ expense.

     

    Professional – the advisor has a caliber of knowledge, training, and experience to be qualified as an expert- it does not mean a person that has an education in pottery making working as a brain surgeon- yet unfortunately very few agents have any qualifications in specific real estate practice.

     

    Advice- providing information is not providing advice: advice requires wide and deep comprehension of multiple dimensions applicable to a wide range of scenarios appropriate for client’s personal circumstances. This requires far more specialist knowledge, training and experience, than merely giving information.

     

     

    The minimum qualifications required before an advisor may even begin on the path to becoming classified as an expert, are:

     

    Education- Higher Academic Degrees in specific real estate disciplines…

     

    Experience- professional working experience in a reputable institutional organisation… The minimum is 3 – 5 years, before embarking on the path to becoming an expert, for which 15 years is required, and 25 years is normal for a senior expert.

     

    Licenses- regulatory licenses, usually in more than one jurisdiction and more than one area of practice.

     

    Ask yourself, does your present advisor qualify ?

     

     

     

    Free Advice – Simple, Cheap and Easy…?

     

    Free Advice is usually no more valuable than misleading information…and is very costly !

    Why Register Your New Habtation Certificate (Yapi Kagit Belgesi) on Your Tapu 


     Question: Should I have the new habitation certificate registered on a new tapu now, or can it wait?

     

    Clarification: Obtaining a newly updated tapu which shows the new habitation certificate, the Yapi Kagit Belgesi, has been issued, is a good idea to have done now, and here’s why. On many old tapus, the status of the planning permissions (and other things such as ownership) is not always clear, and often ambiguous. This is partly because different land registries in Turkey did things differently from one another at different times in the past. (How and why this occurred is another story, with historical and cultural context dating from Ottoman times.) Slowly matters are converging towards standardisation. So on an old tapu, it may be presumed that certain things have been done and are in order, but there is no verification. Sometimes these presumptions apply to more than one issue. So the one sure way to attest to having a tapu that is ‘all clear’, is to have a new one issued. By doing so, the presumptions are then checked officially, in the back channels of the belediye and land registry, and the new tapu will, or should, provide unequivocal attestation that all is in order – at least it eliminates any red flags that would serve as a beacon for future investigation or questions.

     

    So why do it now? The reason is a practical one. Doing it now means that whatever those underlying presumptions were,  they would and should have been checked and verified during the Iskan amnesty process of issuing the new habitation certificates. This process entailed a huge volume of work, overloading back office staff (generating more than $5 billion in revenue), and shortcuts may have been presumed to have been applied.  And if the necessary checks weren’t applied, the relevant actions and procedures will need to be implemented in the belediye and land registry back offices. Doing it now is the best time, whilst all those same checks should have been performed recently, and if they weren’t, now is the time to make sure. Its no good waiting six months from now, when all the overloaded staff in the back offices have said good riddance to that Iskan amnesty workload and back-log, and so happy it’s over and to be rid of it: in six months they won’t remember, will play a blame game with one another, and another ‘mess’ ensues. So get it done now, while there is still some clarity in memories about what was done and why.

     

    An important aspect to consider is that many, many applications were received for types of issues that were not originally envisioned when the tapu iskan amnesty was introduced. In other words, the scope of the amnesty broadened considerably in practice, to accommodate many other types of issues, beyond the initially intended registration of easement right uplift. The ‘wild west’ of Turkish property development over the last ten years has innovatively created all sorts of issues that were never imagined or forseen- the un-imaginable.  How-so-ever the back office personnel at the belediye and land registry have chosen and managed to apply ‘work arounds’ to these many variations for specific cases, only they themselves personally know. Any aspersions cast upon the habitation certificate registration in the future will definitely require legal assistance and costs. And so it’s best to get your tapu, ‘over the finish line’ now, whilst those work-arounds are somewhat recent in the workers memories, and with the same perseverance that was applied in getting your iskan or habitation certificate ‘over the finish line.

     

    The last comment is this… all this is new- it has never been done before… and for that reason there are still unknowns to be dealt with… ‘known unknowns’ and ‘unknown unknowns’…

     

    The very last words are these, from perhaps the most famous saying in the Turkish vernacular….

     

    ‘Burasi Turkiye, her sey olabelir…’

     

    Translation: ‘This is Turkiye- anything and everything is possible…’

    Either choice, whether a Turkish solicitor at a UK based firm, or a solicitor based in Turkey, does not resolve an important conundrum. Turkish solicitors do not have experience of managing risks in the UK like a UK conveyancer or solicitor because they are not licensed to practice in the UK, and thus they do not have the experience of knowing what a UK conveyancing entails- do they have a UK conveyancing license? UK solicitors are not licensed to practice in Turkey and thus do not have the experience or knowledge of dealing with Turkish cadastral property regime, and thus are in no position to manage the conveyancing risks for property transactions in Turkey.

    Underlying this conundrum is that the cadstral real property regime in the UK and in Turkey are completely different. Yes – completely different. Where as the UK system has commonalities with other anglo-saxon and common law countries such as the US and Australia etc, from the days of the British empire, the Turkish system originates from foundations established in Ottoman times and has commonalities with countries such as Greece and Bulgaria from the days of the Ottoman empire.


    These circumstances explain best why the present situation related to conveyancing for foreign property transactions, is so rife with malpractice. The good news is, that this is completely unnecessary and arises only because matters are a bit complex to communicate. The reality in practice is, that if foreigners know and do the simple things Turks know and do, the procedural regime in Turkey has built-in layers of protection for their benefit. The misleading practices and misinformation provided by estate agents and developers dealing with foreigners in ways different from dealing with Turks, like requiring ‘reservation deposits’, is the root cause of so many problems, that negate these built-in protections.

     

    Is it necessary to use a solicitor to benefit from these protections? Absolutely not… the Turkish system is designed to protect both the buyer and the seller, and does so perfectly adequately- assuming some simple basic local know-how. Unfortunately this know-how is concealed by the subterfuge of agents, in their quest to prioritise their commission capture.

    Do I need a solicitor to buy property in Turkey?

    For assistance and managing conveyancing and general real estate related matters in Turkey, appointing a solicitor in most often preferable, to receive the independent professional advice necessary to protect your interests. That first step, of acknowledging the need for protecting one’s interests, is a key aspect of successfully managing your investment interests and assets.

    As one becomes more experienced with different matters and attorneys, quite quickly the realisation emerges that it is not essential for an attorney, or advocate, to do certain things: any one may do them. This is especially true of the many, many procedural matters at notaries, the land registry, the tax office, the local ‘belediye’ municipality.  And in most cases an attorney will not do these things themselves, but will delegate the work to a member of service staff, or an outside practionier- notary, interpreter, clerk, council worker, etc… 

     

    The point is that one needn’t appoint an attorney to provide ‘blanket coverage’ of providing a fully inclusive service, especially for a conveyancing and one needn’t incur the costs that this involves. Attorneys are legal advisers and as such their services should be managed specifically for those aspects of matter requiring specific legal advice or specific legal action. Many times appointing an attorney for dealing with an issue is entirely inappropriate because in the law there are no grounds for an attorney’s intervention to result in a particular outcome. 

     

    So the solution is to obtain more information about an issue, preferably from local Turkish persons that have some experience in a specific matter, but are not attorneys, and most likely they will suggest a simpler and more cost effective way to deal with a matter. In this way one builds social capital with the local community, and so this is always the best and preferred first step to try, along the way to finding a solution.
