Turkey’s Citizenship Investment Program (CBI/CIP) was overwhelmingly successful in previous years. However, there were problems for investors that became apparent later, afterwards. Regulatory changes addressed some of these problems to a limited extent, but did not solve the problems. What are the Three Biggest Problems…?


The Number One problem is the collusion between Citizenship Consultants, Real Estate Agents, and Lawyers to set an articially inflated purchase price for a property, from which they all share profits, hidden from the investor, until trying to sell three or more years later.

 

Solution for Problem Number One: Investors must avoid using Citizenship Consultants and Real Estate Agents, and should negotiate service delivery directly with a law practice that has been pre-qualified by MyTapu Associates. The role of the law practices is simply to represent the investor through the bureaucratic application procedure (essential/ highly recommended for submission, monitoring, feedback and question answering, and passport delivery), and not to provide specialized expertise for the CBI /CIP real estate program, because it is not needed- the regulations and procedures are clearly defined.

 

The Second Problem is to manage and ensure the appraisal value satisfies the minimum price level requirement of the program and matches fairly closely the contractual purchase price. Falsifying with fraudulent procedure the appraisal report is a lazy and stupid way of dealing with this issue, by people that are not truly professional experts and are instead simply ignorant. 

 

Solution for the Second Problem: There are techniques for managing the quality control of appraisal value reports that MyTapu Associates have used for more than eighteen years for mortgage appraisals, but because mortgages are not accepted by the CIP/CBI program, the smooth talking but otherwise ignorant and poorly educated sales profiteers have no knowledge of how to do it.       The very attractive lifestyle benefits of owning a property in Turkiye, are offset by the regrettable practices of estate agents and the solicitors that they refer to. Following the procedures recommended by agents, guides unsuspecting and unknowledgeable buyers into situations where non-Turkish speaking international buyers pay far above local market prices, often for properties that are in some way defective. 

      Reality Check:

      Avoiding this situation requires a recognition of a simple reality. The internet search engine listings for property in Turkiye in non-Turkish foreign languages like English and Arabic, lead straight to the websites of agents that apply these regrettable business practices. These same agents do not even appear in a search engine listing in Turkish. The reason is simple- these type of agents serving foreign investors pay money for various techniques to obtain results for top search engine listings and rankings in foreign languages to catch unsuspecting foreign buyers.

       Dis-Honest Practices:

      These agents can afford to pay this money because the procedures and practices the agents apply when dealing with foreign buyers and sellers, ensure they profit far more than merely from collecting a 2-3 % commission. This is their ‘standard business practice’, involving a series of steps that are intentionally designed to limit a foreign buyer’s negotiating power, and visibility. Usually these steps are combined with different pressure tactics involving fictitiously created urgency, and other emotional and psychological tactics, accompanied by persuasive skills, and often various degrees of dramatic amateur ‘acting’. 

      Profits from Hidden Price Mark-Ups:

      These practices typically involve the ‘hidden price mark-up’ scam – where-by an agent agrees not to charge a seller (or developer/constructor) a commission, if the agent can keep all money obtained by selling the property for more than a specific price level. And the profit from selling above that price- the hidden price mark up -  agents put in their pocket as their profit- often shared with the attorneys they recommend to clients, the Citizenship CBI/CIP consultants they work with, valuation experts, and mortgage brokers that provide false assurances of mortgage finance, just to encourage the client’s to make deposit payments in advance. 

      Don’t Believe It… !

      Just because an agent’s website is now providing information on ‘Due Diligence’, does NOT mean they actually perform professional Due Diligence. Usually, the agent has simply obtained the information on this and other topics from MyTapu’s website and placed onto their own website to appear legitimate… a common practice for years !

      Just One Business- Manipulation:

      Avoiding these practices can NOT be done by using an agent that relies on these practices for their business, because no matter what persuasive assurances they provide, these practices ARE their business- not providing standard real estate agency services. So for example, if a buyer wants to offer a price without deposit or below listing price to a seller, the agent’s usual ploy will be to not to inform the seller at all, and eventually inform the buyer falsely.’ there is another buyer at a higher price’ , or ‘the property has been sold’, or ‘the property has been taken off the market’… and neither the seller nor the buyer will know any different – because they both rely on the agent’s communication. This is a major reason why local Turk’s do not use agents. In summary, the only business these agents are interested in doing, is the business of capturing the hidden price mark-up profit- they won’t bother doing anything else. Which becomes understandable when realizing that the ‘hidden price mark-up profits’ can amount to as much as 80% higher than the true sales price.

      Yes, FOR a factual real world EXAMPLE, a USD $ 100,000 price mark-up on a  $ 186,000 property being offered for sale at $ 286,000 in Kagithane, istanbul. 

      Solutions- MyTapu Transaction Services:

      How do Professional Transaction Services solve this problem for property buyers and sellers? The solution can be summarized briefly as follows:

      • Procedures: Follow the steps required for ensuring the buyer or seller is not dis-advantaged; do NOT rely on information on the internet nor from AI, because this information is just repeating what the pirates would like to persuade an unsuspecting buyer or seller to believe.
      • Practices: Apply standard best practices for transaction management used by institutional investment managers of investment funds and corporates when buying real estate;

      • Price Checks: Use a Professional Valuation Service instead of a local appraisal report known as an Eksper Rapor, because the Eksper Report does not provide accurate market price valuations because they charge so little it is not possible to obtain accurate information on real transaction prices of comparable properties, and instead relies on price averaging and other short-cuts resulting in distortions. An Eksper Rapor provides much helpful information but the attention to market price discovery typically comprises less than 10-15% of such reports. 
      • Preparations: Complete the advance preparations necessary to ensure the buyer is able to buy property like a local Turkish person;
      • Timing: allow ample time for a price negotiation to be accepted –less than ninety days is often not sufficient, so expectations must be managed realistically in regard to seasonal factors and other aspects;
      • Choices: Maintain a wide range of property purchase choices, without becoming emotionally attached to any pictures or concepts – this is a small price to pay for protecting wealth. 
      • Persistence: patiently continue with the techniques applied by an experienced Professional Transaction Specialist, and do not be deterred by agents’ refusals to cooperate, because non-cooperation is obviously a red-flag that is best avoided.  Also avoid entering a situation where an agent provides a constant stream of false and misleading information, and uses psychological and emotional persuasion tactics.
      • Sourcing: avoid any service providers that are being paid commissions – instead, use a non-commission based services for identifying property to buy, like MyTapu’s Property Search and Selection Service. Often it is possible to buy property directly from owners, and thus ideally avoiding these English and Arabic speaking sharks and pirates that pretend to be honest agents.

        As of January 1st, 2026 new regulations come into effect requiring:

        • The payment for real estate property purchases in Turkiye to be accompanied by a local commercial bank’s documented proof of transfer.
        • The price and value must be the same as declared at the land registry and appearing on any contract.
        • The de facto payment procedure has now switched over to the ‘New Low Risk, Low Cost Solutions’ described below- a very positive development for protection of both buying investors and selling investors.
        • The reasons for this change pertain to tax collection, in addition to fraud mitigation.



        For Buyers and Sellers, this payment channel is now the de factor standard practice accepted by the Land Registries in Turkiye for property purchase and sale transactions due to new regulations Jan 1 2026.



        Traditional Low Risk, Low Cost Solutions:


        The Turkish legal framework has cost effective payment solutions that enable Turks and Turkish speaking people to buy and sell safely. These methods are common standard practice and MyTapu Associates provides  Transaction Services   to  explain these, specify the documents required, and manage the procedures.


        A Payment is an Exchange- for What ? 


        The exchange should be for more than a verbal promise from a seller, agent. constructor, etc …!!! First, before making payment, it is important to check: what have has been received in return for making this payment ? 


        Payment by Digital Transfers:


        Making unsecured inter-bank or swift transfers, or crypto-currency payments, to the seller are generally not recommended, and open potential for future problems.  Preparations are required, increasing costs and expenses, beyond what is typically expected. For example, absolutely essential is having a notarized contract stating the payment terms and stating payment instructions corresponding to the payment a buyer is preparing. Anything less is inviting problems, and added legal costs, potentially leading to litigation for other related reasons. 

        However, if the transactional procedures and documentation are prepared appropriately, the risks are manageable, and acceptable. The problems arise when the precautions and preparations are replaced by short-cuts and omissions, and the latter usually occur when the transferring party is attempting to save on costs and expenses- very unwise.


        Cash & Precious Metals Payments:


        Cash payment transactions are essentially no longer an option for a multitude of reasons, the most obvious being risks, and expenses, for example, counting cash and obtaining notarized attestations etc The sheer volume of paper cash Turkish Lira  required makes it nearly impossible. The sales price must be in Turkish Lira. Foreign currency payments incur additional scrutiny and work-arounds; payment in precious metals (coin or bullion) is easily accessible and viable everywhere in Turkiye, but also incur similar risks and expenses.         Non- Digital & Non-Cash Payments- Documentary Payments: 


        There are ways of organsing the payments in settlement of a transaction that do not require digital payments, contracts, precious metals, nor cash. A preferred method, in conjunction with other documentation, to eliminate risks, and ensure immediate liquid funds transfer, is a type of bank draft which has funds blocked and frozen for the purpose of the real estate transaction by the issuing buyer's bank, payable only to the name designated on the cheque, being that of the property seller. For the recipient named on the cheque this way, this form of documentary payment is essentially a cash equivalent. This is a traditional documentary payment technique in common widespread practice.

        Payment’s for Citizenship Investments:


        • ·An investor must not simply transfer foreign currency to the seller.
        • ·Payments must conform to a protocol where-by a local Turkish Bank sells the foreign currency to the Turkish Central Bank- a procedure for the purpose of establishing an accounting record of the inflow of funds to Turkiye.
        • ·The protocol also ensures compliance with regulations requiring the purchase price and value be paid in Turkish Lira, thereby fulfilling a policy initiative intended to reduce the depreciation rate of the Lira.
        • ·An investor must comply with this procedure, otherwise the Citizenship Investment procedure can not be fulfilled.
        • ·The protocol is named DAB (Döviz Alım Belgesi /Currency Purchase Certificate), and the bank issues this certificate to accompany the CIP/CBI application.  
        • ·Without the DAB references the Land Registry will not process the real estate purchase transaction.

        • ·Investors must comply, and the work is done by the investor’s local Turkish Bank (so selecting the right bank is important-  request our advice) but otherwise investor’s should not be unduly concerned because there are practical work-around solutions for dealing with the issues arisng such as price etc. More details about this are available on request.



        New Low Risk, Low Cost Solutions:


        As Turkiye’s Land Registry Administration implements a multi-decade modernization and standardization program, vastly improved digital systems are coming into service that make the entire payment settlement process faster, cheaper, and eliminate risks to vanishing point.

This is the clearing bank for administering bank transfer payments between real estate buyers and sellers for transactions utilizing the Turkish land registries’ digital payments infrastructure. The IT infrastructure systems of this bank are near flawless as can be – every business day it settles payments worth hundreds of millions of Dollars for Turkish government bonds and Istanbul Stock Exchange shares for foreign institutional and local Turkish fund managers and investors generally.         Beware Agent’s Advice:


        Despite all these advantages, this payment alternative, like that for documentary payment technique mentioned above, is rarely if ever mentioned on the websites or by that personnel of the real estate agents that specialize in serving foreign real estate buyers. The reasons are clear- in addition to pure ignorance, there is no mention because using these payment alternatives eliminates the agents’ ability to capture profits on the transaction that they hide from the buyer the and seller. Check an agent’s or adviser’s website to see if these alternatives are mentioned. If there is no mention, they are likely intending to capture a large portion of the buyer's and seller's transaction price. Whether or not payment methods are mentioned, in any case a buyer should:

         

        • Never make more than one payment for the purchase of the property;
        • Never make payments directly to a constructor, seller, agent, or attorney.
        • The problems and warnings about making ‘reservation deposits' are well known for years now and should never be agreed.
        • In cases where installment payments are being made for properties under construction, these are high risk with investment profile entirely different from a construction completed property, carrying multiple additional risks that require specific contract due diligence on terms and considerations (not simple) and are more costly to execute safely, and potentially far more costly to rectify a plethora of ensuing problematic issues.  

        The simple truth is that selecting a property to purchase from an agent’s website in Turkiye is not a sensible practice for investors. The profit guaranteed in this way is only for the agent and selling constructor/ developer, not the investor. The overwhelming evidence of investors that have bought in this way all complain they are unable to sell the properties now at prices they paid for the property in previous years as long ago as 2015.         This is often the first question asked by a property owner considering whether to sell their property. To find the answer, the owner may look on the internet at agents' property listings to check prices, and then perhaps call an agent… but the agent may know the prices of his own listings and maybe the prices of properties listed by two or three other agents which all-together may comprise 15-20% of the total of similar properties listed...but not ALL of the similar properties listed in the whole market....  These were the normal steps before the digital era.         So search engine algos receive huge input volumes of false information,  but how does that false information come into existence on the internet in the first place?

         

        The primary reasons are:


        Agents’ Practices – Agents priorities are to maximize and secure their commission and ‘hidden price-markup profits’ as early as possible in the sales process. For that purpose, agents are true experts – every other consideration is secondary, or non-existent. Providing mis-information that misleads a buyer for this purpose is very profitable, The information is free, but the results that mislead the buyer provide the agents with huge profits that often range as high as 50% of the true market value of the property- and that 50% is the buyer’s ‘hidden cost’- which is very real, as the buyer discovers when they try to sell the property- which is usually years later. Free information is very costly, and in reality is very expensive .

         

        Social Media, Blog References & Discussion Boards - Recent research reveals that 80% of internet buyers research blog articles and discussion boards before completing a purchase. Unfortunately a very large proportion of the information on blogs and discussion boards is also inaccurate and misleading. Often this is because agents are writing the information while using membership identities to appear as buyers. Many times the incorrect and inaccurate information is provided by a bonafide, authentic buyer, and describes what they know- but what they know is usually some small fraction of the facts they learned from brief discussions with informed sources, but most often is obtained from hearsay because they themselves never paid fees to receive independent professional advice, because they chose instead to save money and use ‘free’ advice, which has resulted in huge hidden costs, which they may not yet be aware of ! Blogs and discussion boards are not a reliable source of information.

         

        Information Created by Artificial Intelligence (AI)– the huge increase in the use of AI to create information on the internet (websites, articles, research data, etc) has replicated the proliferation of false and misleading information on the internet. The AI algos (see above) produce the new information by scanning the internet and compiling the same false and misleading information into new false and misleading information (garbage in leads to garbage out).  The volume of false and misleading information is now larger than ever, and search engines rank that information very highly, not because it is correct and accurate, but because the AI algos are very good at structuring the presentation of the inaccurate and incorrect information.

         

        The irony is that many ‘trusted and reputable’ sources of information are ranked highly in search results because they are considered an ‘authority’ – even when the information provided is incorrect and inaccurate... but only an expert can know this.

         

        Very good examples of this are ‘Trust Pilot’ and ‘Scam Advisor’. These websites thrive on a valuable concept of exposing fraudsters by naming and shaming publicly… Unfortunately, they also enable fraudsters and scammers to cover their dastardly deeds with ‘reputation management’ that involve the scamsters posting a large number of fake customer reviews that make them look great. Having worked for over a decade fixing investors problems that have been created by these scammers, we know who they are and what they do, and so when checking the reviews of these scammers and fraudsters on the Trust Pilot and Scam Advisor websites,  we see these scammers and fraudsters have great high trust rankings- because they have cosmetically covered their evil deeds. On the other hand, when looking at our own MyTapu review on these websites we see one negative review… from just one customer of more than 3,000 served. And this review is making false, factually inaccurate and incorrect allegations about the services received… These allegations were presumably contrived by that disgruntled customer because MyTapu experts refused to follow that customer’s directions to avoid compliance with anti-money laundering regulations…which is a criminal offence ! . No surprise the customer himself, in his home country is a … yes, you guessed it.. an estate agent..>!

        There are Two Primary Reasons why false and inaccurate information dominates search engines rankings for English Search Results about Property in Turkey ….


        The first reason, is because the English-speaking agents with English language websites, produce large quantities of free information that is incorrect and inaccurate to mislead customers for the purpose of the agent maximizing their profits. The extent of this problem for Turkish language information is far less.

         

        The second reason  is because false and misleading information is provided for free, because it is worse than worthless; instead it leads to huge profits for the authors that provide it… (usually agents, but also other Citizenship advisors, lawyers, appraisal experts- anyone and everyone that has a conflict of interest because they share the huge hidden profits with the agent- profits the property buyer pays for). Factually correct and accurate information has value, and is not provided for free… see below.

        The Search Algos have great difficulty in evaluating the best sources of factually correct and accurate information, because the information does not appear for free on the internet.

         

        So unless you hear of a good source by word of mouth verbally, it is very difficult to identify factually from internet search results.  Private networks of like minded groups of people sharing their first hand experiences privately, are a solution that helps, but the information is not on the internet, but sometimes may be in encrypted chat networks on apps like Telegram Messenger.
