Advance planning allowing ample time for your purchase, results in many benefits. 

The most financially important of these benefits, is the reduction in sales price when ample time is allowed for the price negotiation. In the years since 2022 sellers and buyers are reporting that the actual sales price of the property transaction they made was about 20-30% below the listed sales price first asked. That’s a big discount ! 

To benefit from a similar discount, follow these steps:

1.  Plan to complete payment your property purchase either in early December OR late March- never between April (Easter) and September.

    The very attractive lifestyle benefits of owning a property in Turkiye, are offset by the regrettable practices of estate agents and the solicitors that they refer to. Following the procedures recommended by agents, guides unsuspecting and unknowledgeable buyers into situations where non-Turkish speaking international buyers pay far above local market prices, often for properties that are in some way defective. 

    Reality Check:

    Avoiding this situation requires a recognition of a simple reality. The internet search engine listings for property in Turkiye in non-Turkish foreign languages like English and Arabic, lead straight to the websites of agents that apply these regrettable business practices. These same agents do not even appear in a search engine listing in Turkish. The reason is simple- these type of agents serving foreign investors pay money for various techniques to obtain results for top search engine listings and rankings in foreign languages to catch unsuspecting foreign buyers.

     Dis-Honest Practices:

    These agents can afford to pay this money because the procedures and practices the agents apply when dealing with foreign buyers and sellers, ensure they profit far more than merely from collecting a 2-3 % commission. This is their ‘standard business practice’, involving a series of steps that are intentionally designed to limit a foreign buyer’s negotiating power, and visibility. Usually these steps are combined with different pressure tactics involving fictitiously created urgency, and other emotional and psychological tactics, accompanied by persuasive skills, and often various degrees of dramatic amateur ‘acting’. 

    Profits from Hidden Price Mark-Ups:

    These practices typically involve the ‘hidden price mark-up’ scam – where-by an agent agrees not to charge a seller (or developer/constructor) a commission, if the agent can keep all money obtained by selling the property for more than a specific price level. And the profit from selling above that price- the hidden price mark up -  agents put in their pocket as their profit- often shared with the attorneys they recommend to clients, the Citizenship CBI/CIP consultants they work with, valuation experts, and mortgage brokers that provide false assurances of mortgage finance, just to encourage the client’s to make deposit payments in advance. 

    Don’t Believe It… !

    Just because an agent’s website is now providing information on ‘Due Diligence’, does NOT mean they actually perform professional Due Diligence. Usually, the agent has simply obtained the information on this and other topics from MyTapu’s website and placed onto their own website to appear legitimate… a common practice for years !

    Just One Business- Manipulation:

    Avoiding these practices can NOT be done by using an agent that relies on these practices for their business, because no matter what persuasive assurances they provide, these practices ARE their business- not providing standard real estate agency services. So for example, if a buyer wants to offer a price without deposit or below listing price to a seller, the agent’s usual ploy will be to not to inform the seller at all, and eventually inform the buyer falsely.’ there is another buyer at a higher price’ , or ‘the property has been sold’, or ‘the property has been taken off the market’… and neither the seller nor the buyer will know any different – because they both rely on the agent’s communication. This is a major reason why local Turk’s do not use agents. In summary, the only business these agents are interested in doing, is the business of capturing the hidden price mark-up profit- they won’t bother doing anything else. Which becomes understandable when realizing that the ‘hidden price mark-up profits’ can amount to as much as 80% higher than the true sales price.

    Yes, FOR a factual real world EXAMPLE, a USD $ 100,000 price mark-up on a  $ 186,000 property being offered for sale at $ 286,000 in Kagithane, istanbul. 

    Solutions- MyTapu Transaction Services:

    • Procedures: Follow the steps required for ensuring the buyer or seller is not dis-advantaged; do NOT rely on information on the internet nor from AI, because this information is just repeating what the pirates would like to persuade an unsuspecting buyer or seller to believe.

    • Price Checks: Use a Professional Valuation Service instead of a local appraisal report known as an Eksper Rapor, because the Eksper Report does not provide accurate market price valuations because they charge so little it is not possible to obtain accurate information on real transaction prices of comparable properties, and instead relies on price averaging and other short-cuts resulting in distortions. An Eksper Rapor provides much helpful information but the attention to market price discovery typically comprises less than 10-15% of such reports. 
    • Preparations: Complete the advance preparations necessary to ensure the buyer is able to buy property like a local Turkish person;
    • Timing: allow ample time for a price negotiation to be accepted –less than ninety days is often not sufficient, so expectations must be managed realistically in regard to seasonal factors and other aspects;
    • Choices: Maintain a wide range of property purchase choices, without becoming emotionally attached to any pictures or concepts – this is a small price to pay for protecting wealth. 
    • Persistence: patiently continue with the techniques applied by an experienced Professional Transaction Specialist, and do not be deterred by agents’ refusals to cooperate, because non-cooperation is obviously a red-flag that is best avoided.  Also avoid entering a situation where an agent provides a constant stream of false and misleading information, and uses psychological and emotional persuasion tactics.
    • Sourcing: avoid any service providers that are being paid commissions – instead, use a non-commission based services for identifying property to buy, like MyTapu’s Property Search and Selection Service. Often it is possible to buy property directly from owners, and thus ideally avoiding these English and Arabic speaking sharks and pirates that pretend to be honest agents.

      For a person that is intent on living in Turkiye, renting before buying allows one to get to know the local area better, before committing a capital sum, which is takes more time and effort to rectify if the choice isn’t the right decision.  Renting before buying results in having more time at a more relaxed pace to explore and gain insights about more and better choices with which to make better decisions. A foreign buyer has so much choice when choosing locations, property types, and lifestyles generally, that it almost seems foolish to imagine making a snap decision to buy, without exploring more options, first.

      Is it Easy to Rent Before Buying ?

      Yes it is a comparatively easy process to find a rental property and enter into the rental agreement, as long the necessary guidance is available. Finding a property is best done with theonline property portals, where the choice is much larger and better than with an agent. Entering the contract is fairly simple because the contracts are standardized-  for the local Turks renting from local Turks. If you are non-Turkish, the situation is different, and the contract and agreement needs to reflect this, as do the main heads of contract. A lawyer can oversee the contract drafting in Turkish to ensure proper convention and execution, but local lawyers typically have limited experience advising non-Turkish renters on rental contracts that are longer then a couple of weeks for which such advice isn’t really needed. For a long-term rental, the advice of an experienced professional is advisable, because there are issues that are specific to foreigners that local Turkish landlords and local lawyers usually haven’t considered before.

       

      In addition, the most challenging aspect is the management of the residence permit application and procedures. Several years ago it was a relatively easy procedure, and certainty, but no longer. If the rental term is less than 90 days, the renter can usually manage by using a tourist visa, which allows for staying in Turkiye for up to 90 days in a 180-day period. For a longer period, the short-term residency permit application and procedure is required. There are specific requirements in this procedure that govern the acceptability of the property being rented, relating to rental permits, which also relate to building permits. For these aspects, independent professional advice is required.

       

      In addition there may be additional aspects that require experienced professional advice, related to rental prices, security deposits, maintenance, etc. Again, for these, experienced advice is required- relying on layman’s hearsay can be a costly mistake,

      How to Buy Property in Turkey for a Bargain

      For bargain hunters, now is a very good time to buy property in Istanbul and Turkey. Many bargain buyers make the mistake of thinking the bargains are ‘there for the taking’. Deceptive agents will tell buyers that low Turkish Lira exchange rates mean that property prices are low. This is just a sales trick, because Turkish sellers also know what their property is worth in US Dollar and Euro, of course, because Turkish sellers have always valued their property in USD since the early 1990’s.


      For a buyer that is investing in property in Turkey for citizenship purposes, it is essential that the steps below are followed. Otherwise, the investor may discover the property purchase price of  $400,000 has an appraised value of several thousand less, and does not qualify sufficiently for citizenship application purposes.


      Buying a bargain is not the same as the usual way of buying. First, a buyer rarely, if ever, (NEVER ! ) finds a bargain by contacting the website of a real estate agent, or developer.  Second, the buying procedure recommended by agents and developer is described in a way that is for their advantage, and that procedure never benefits a buyer, especially if a buyer wants to buy at bargain prices. And be warned, the procedure recommended by agents and developers most often omits the most important step: assessing the risks related to permits, title, and payment: the ‘due diligence’. The worst part of following agents and developers advice, is that usually they recommend paying a ‘reservation deposit’. A bargain buyer MUST avoid an agent or developer that tries this ploy: it is just a trick; read more about reservation deposits here. A buyer that pays a ‘reservation deposit’ is never in a position to negotiate the best price.


      This is a list of the key stages in the process of ‘buying a bargain’:

      1. Advance Preparation 
      2. Finding the Property
      3. Due Diligence
      4. Conveyance and Completion

      Now let’s look at each of these stages briefly, focusing on the most important points.


      1) Advance Preparation

      The first step buyers take to find a bargain priced property is to search an agent’s website. This is also the first, and biggest, mistake. In a rush to avoid ‘losing’ a bargain that looks cheap, the agent requests a ‘reservation deposit’. Paying a reservation deposit is the second mistake buyers make, and why so many foreigners become ‘locked in’ to a transaction at prices much above market value, for properties that are often defective.


      Buying successfully at bargain prices requires 100% avoidance of everything in the paragraph above. Instead, the first step, is the ‘Advance Preparation’, that enables the foreigner to buy in the same way as a local Turk. There is no alternative. Buying a bargain means negotiating the best price and IMMEDIATELY closing the deal with payment and completion. Sellers do not wait around for foreign buyers to get their paperwork in order- that can take weeks. Searching for property and negotiating a bargain price is a complete waste of time, unless the buyer has completed the advance preparations necessary to ‘put cash on the table’ and thus immediately complete the transfer of title from the seller.  And this is the ONLY way to take advantage of foreign exchange $/TL currency fluctuations of 10% or more in a week. It is no good waiting for the fluctuations, and then trying to purchase, if the paperwork is not ready.  Advance preparations is the first step in the Investor's Tool-Kit, and takes 3-6 weeks typically, and include such matters as local registrations, local bank account preparations, authorisations, etc


      2) Finding the Property

      Searching the internet for a property for sale in Turkey is the least likely method of finding a bargain to buy, and also the most risky. The top five pages (and more) on internet search engines are occupied by real estate agents and developers’ sales agents. They ‘see you coming’, and are waiting for you, with their ‘games’ and tricks. The result? More than 85% of foreigners have paid prices 25% or more above the fair market value, or have purchased defective properties.


      Fortunately there are many better channels to find bargain properties at discounted prices, but if a buyer does not speak Turkish, these will remain undiscovered. These channels include ‘for sale by owner’, bank repossessions, auction, internal databases, and private networks. SEE BELOW.  Generally these channels require Turkish language skills. There are more than a million properties on the market in Turkey, and ample supply to serve two years of buyers’ demand. Wise buyers looking for bargains will take advantage of these circumstances, by sourcing property from these channels, with an experienced and professional Property Finder.


      A good ‘Property Finder’ should be capable of searching these sources for properties meeting a buyer’s specifications, but if that is all they do, they are only doing half the job. A professional Property Finder or Sourcing Agent should also be capable of completing ALL aspects of ‘’due diligence’ on the property.


      3) Due Diligence

      Is the person selling the property the owner? Is the property being bought, the same property that was seen?  Does the property have the correct permits? Is the contract legally structured and executed, or a defective contract (most agents’ contracts are) which will just cost the buyer more in legal expenses, if they try and enforce it? Is the building constructed in accordance with regulations, or will it be subject to a demolition order? These are a few of the questions answered by Due Diligence. The buyer should never rely upon the seller or his agent for the answers. For ‘due diligence’, independent advice, from an experienced professional, is essential.


      Is the property being sold at a fair price? To solve the chronic problem of agents selling property to foreigners at excessively high prices, new regulations now make it a requirement that a foreign buyer must be given an ‘appraisal report’ (an ‘eksper rapor’). These reports show the market price of the property. Agents and developers will still try and convince buyers that these valuation reports under-value property prices by 10% to 20%, but this is simply another misleading tactic to hide the agents’ hidden price mark-ups, and hidden commissions.


      4) Conveyance of Title and Completion

      Transferring the title from the seller to the buyer involves numerous small tasks and documentation, mostly related to payment of taxes and governmental fees. With the guidance of a professional adviser, and supported by a translator, a foreign buyer can usually manage the conveyance of title at the land registry in person themselves.


      The simplest and most cost effective technique for the conveyance is the procedure used by local Turks. The transfer of ownership and the payment are both made together, simultaneously. To reduce risk, steps are prepared in advance for the payment documentation. Sometimes a purchase may have contentious aspects, for example, when the buyer has agreed a discounted price with the seller, but is suspicious that the seller may try ‘last minute tricks’ to get a higher price. In such cases it is advisable to have a professional adviser present.
