How will these changes impact property prices in Turkiye?

These changes for payment procedures, recording and releasing factual transaction price data, will have a huge impact on property prices in Turkiye, and an impressive example of how astute regulatory policy changes may have a positive benefit for consumers. .

In locations where foreign buying is widespread and prevalent, will be most immediately impacted and this will become evident to the market in general likely in the final quarter of 2026 or first quarter of 2027. One such practice agents have begun using is to demand a previously undisclosed commission or fee from the buyer immediately before the final closing transaction set up. Naturally we expect other practices to evolve. In fraud prevention work, one principle always applies- if a fraudster is intent on committing a fraud, no amount of regulation will 100% prevent it.

How were English speaking agents profiteering from false price manipulation?

On a purchase transaction, there were practices used to ensure the ‘;middlemen’ profited from huge artificial price mark-ups amounting to a standard 20%-30% profit. This is possible because un-informed foreign buyers, typically those that were intent on avoiding paying fees to professional advisors and lawyers, believed there was just one price involved in a transaction, the purchase /sales prices. However, in Turkiye, property purchase and sale transactions include three prices, all different:

The price received by the agent from the buyer.
The price paid by the agent to the seller.
The price declared at the land registry, which typically vastly understated the true transaction prices for the purpose of reducing the capital gains tax of the Turkish seller, and reducing the transfer 4% transaction tax payable by buyers and sellers.

The practice began with UK and Irish estate agents, and through them the practice grew to include Turkish agents, and citizenship and immigration consultants, lawyers, bankers, specialist service providers, for example the journalists producing specialist media such as citizenship and immigration newsletters, international property sales websites, appraisal valuation experts, translators & interpreters, etc

When did this begin?

The practice began with UK and Irish estate agents ,’;mis-selling’ and duping investors from their home countries into over-priced properties in Turkiye. This began in the period 2003-2010 when new laws allowed residential property purchases in Turkiye, followed by new laws permitting mortgages, for international buyers. at that time there were instances where false promises and mis-leading tactics captured 300-400 buyers for specific property developments on the western coast in Turkiye, and the practice spread to Istanbul. In the UK and Ireland there were successful fraud prosecutions against the agents, so they left their home countries and moved business to Istanbul and Turkiye, where they continue to operate to this day, posing as ‘honest brokers’ and doing what they do best... lying is their standard business practice..

Why isn’t this a fraud in Turkiye?

In other countries such practices would be considered fraud, but in Turkiye the legal definition of fraud does not encompass this practice, because it is not applied to a large group of buyers simultaneously en-masse all at the same time, but instead is applied one-by-one, to hundreds of investors- all investors.

Advance planning allowing ample time for your purchase, results in many benefits.

The most financially important of these benefits, is the reduction in sales price when ample time is allowed for the price negotiation. In the years since 2022 sellers and buyers are reporting that the actual sales price of the property transaction they made was about 20-30% below the listed sales price first asked. That’s a big discount !

To benefit from a similar discount, follow these steps:

1. Plan to complete payment your property purchase either in early December OR late March- never between April (Easter) and September.

What are the Three Biggest Problems…?

The Number One problem is the collusion between Citizenship Consultants, Real Estate Agents, and Lawyers to set an articially inflated purchase price for a property, from which they all share profits, hidden from the investor, until trying to sell three or more years later.

Solution for Problem Number One: Investors must avoid using Citizenship Consultants and Real Estate Agents, and should negotiate service delivery directly with a law practice that has been pre-qualified by MyTapu Associates. The role of the law practices is simply to represent the investor through the bureaucratic application procedure (essential/ highly recommended for submission, monitoring, feedback and question answering, and passport delivery), and not to provide specialized expertise for the CBI /CIP real estate program, because it is not needed- the regulations and procedures are clearly defined.

The Second Problem is to manage and ensure the appraisal value satisfies the minimum price level requirement of the program and matches fairly closely the contractual purchase price. Falsifying with fraudulent procedure the appraisal report is a lazy and stupid way of dealing with this issue, by people that are not truly professional experts and are instead simply ignorant.

Recent geo-political conflict has pushed up oil and gas prices, and historically, that has not been so good for Turkiye's foreign currency balances and payments… but times are changing. For example, valuations on the Istanbul are less than 1/4 of the levels elsewhere.. We are noting a sustained up tick in institutional investor enquiries and interest by finance providers.... The capital flow is expected to set the stage for a gradual resumption of competitive returns on capital....

Notably, Turkish policy makers are showing serious intent with the recent sale of a sizeable portion of Turkiye's gold reserves recently; with Dollar swaps for supporting the Lira… good for policy credence… and good market timing (!)…:) ... adding additional flexibility to their hand….

The Gold swap transaction was conducted via London with central bankers' proxy agents, and triggered the sell off in gold prices. Ironically, when the price of gold fell, the Turkish public rushed into the Bazaar, a major gold trading center for more than a thousand years. Hoping to get their hands on gold at cheap prices, there was some dis-appointment as the crowds were forced to wait in line two to four hours, and longer. Downside risk is the lowest (yes lower than slums) and upside performance is the steadiest, most liquid, and incessantly ongoing- limited supply is always less than the increasing demand, in a world where the wealthiest continue to get wealthier, faster than others. These properties are generally not considered desirable lifestyle locations by local Turks. Furthermore, the vast supply pipeline of projects completed and in development assures no or limited exit price increases due to supply and demand. The investment profile is typically 10-15% downside and 0-5% upside over a three years CIP / CBI holding period. Entry pricing is important in order not to shift this profile further into unprofitability. Over-priced for the location, and having resale exit price expectations at best of recouping the purchase entry price, perhaps with a slight uplift, but not a commensurate return on capital available in other real estate segments, nor asset classes. The key to protecting capital is to identify the property on offer that is the smallest premium to true market value, thereby minimizing exit price risk. The Market Price Reports available from MyTapu Associates are key to measuring the entry price’s premium to true market value, which is the key determinate of investment performance, since resale exit price upside is limited to non-existent over the CIP/CBI holding period.

...these properties typically rely on misleading descriptions of various sorts, often related to their location, often referred to with a desirable upper tier location name, when in reality they are not in that location. The premium pricing they are offered at makes this segment the riskiest. The premium to true market value is usually in excess of 20%, and so the investment profile is the least favourable, simply because prices are highly unlikely to achieve that amount of uplift over the three year holding period. Instead, if the uplift is only 10%, the investor will suffer 10% loss of capital when selling at resale exit market prices. For a longer holding period of 5-15 years, the uplift potential may typically be greater than the low-end segment, but the certainty of such an expectation is in doubt. For real estate investors Turkiye offers alluring prospects for investment returns and lifestyle benefits. These attractions have resulted in a surge in international buyers at various times during the past two decades. This surge has also resulted in widespread abuse and fraud by unscrupulous middlemen.

Turkish Law

One reason fraud is so prevalent is because a prosecution fraud prosecution in Turkiye requires widespread evidence of repeated malpractice effecting many victims. Unlike many countries, evidence is required from more than one transaction effecting more than one victim. The courts are also reluctant to pass judgment on what may or may not have been agreed between two parties on any one transaction.

New Regulations

Effective January 1, 2026 new Land Registry regulations have been introduced for property purchase and sale transactions:

All payments to be made by bank transfers to Land Registries’ on-line banking services
Checking by Land Registries to ensure transaction price declarations, contract prices, and payment amounts - must all be the same

This is a Heading

An investor receiving a request to make payment directly to a middleman should cease engagement. Such middlemen have been known to be receiving undisclosed profit sharing of hidden price mark-ups, and these middlemen collude together, including agents, citizenship consultants, lawyers, etc.

Multiple Payments

In addition, the new measure also brings the business process for property transactions with foreigners into closer alignment with that used by local Turks, whereby one payment transaction suffices for the purchase, instead of an additional payment or any advance payment, reservation deposit etc.

Price Fraud

The scope for fraud still exists, as regulators know, a fraudster with a determined intention to deceive will find ways to do so. Thankfully, the new regulations further narrow the scope available to fraudsters. How to Obtain a Discounted Price by Planning the Timing of Your Property Purchase ?

Advance planning allowing ample time for your purchase, results in many benefits.

To benefit from a similar discount, follow these steps:

1. Plan to complete payment your property purchase either in early December OR late March- never between April (Easter) and September.

2. Begin your property search a minimum of 9 months in advance (or longer) – that Means beginning the Property Search & Selection service with your MyTapu Property Finder in March.

3. Make a short Buy List of 5-8 properties to buy;

4. Complete all Due Diligence steps on each property (there is a way to reduce the time and cost of doing this- your MyTapu Property Finder knows how to do it, as part of the preliminary Negotiation tactics he/she uses).

5. Submit your price offer to the seller at a reasonable price advised by your Property Finder, taking into account the real supply and demand situation in the market, shown in the Market Price Valuation Report.

6. Do not expect the seller to accept this price… instead, plan to re-submit the same purchase price bid every month- or use a pricing strategy advised by your Property Finder…

7. Remember, the MyTapu Property Finder is a Transaction Manager that is a Qualified Investment advisor- not a real estate agent.

8. Keep track of prices of the properties shown in the Market Price Valuation Report during the time from April through November (or February), and the sales of properties on your Buy List.

10. Once you have received the seller’s concessions to sell at a reasonable price, and very happily at a discount from the original sales listing price, you the buyer, will have purchased at a price that represents a sound investment, protecting capital and preserving wealth.
